Purpose of this policy

This Privacy Policy explains how BelongBack processes the personal data of individuals who visit this website, contract our services, or communicate with us.

BelongBack provides a mediation, management, and tracking service for files aimed at locating and eventually recovering items lost with third parties, including, but not limited to, airports, airlines, hotels, transport companies, lost property offices, public bodies, and logistics operators, in Spain and other countries.

What data do we process

Depending on the case, we may process the following categories of data:

a) Identification and contact data

First and last name, email, telephone number, country of residence, language of communication and, where applicable, postal address.

b) File or case data

Description of the lost item, date and place of loss, internal or third-party references, flight, booking, stay or journey information, details of the hotel, airport, airline, station or establishment involved, photographs of the item, communications held and any other information necessary to process the file.

c) Accreditation or legitimation data

Information or documentation necessary to prove that the claimant is the owner of the item or is authorized to act on their behalf. Generally, BelongBack will try to avoid requesting full copies of identification documents when a less intrusive alternative exists.

d) Economic and billing data

Data necessary to manage the collection of the service, invoicing, refunds, payment incidents and compliance with accounting, tax and administrative obligations.

e) Technical and browsing data

IP address, technical identifiers, logs, device data, browser and website usage when you access the web or interact with our forms, systems or communications.

f) Customer service data

Queries, incidents, claims, messages and any documentation you send us during the management of the service or the commercial relationship.

Data generally not requested

BelongBack does not generally request special categories of personal data or data relating to criminal convictions and offenses.

Please do not send health, biometric, ideological, religious, trade union, sex life or sexual orientation data, nor criminal information, unless strictly necessary for the specific management of the file and there is a valid legal basis for its processing.

We also do not request a full copy of the ID card, NIE or passport by default. We may only request identification documentation when strictly necessary to prove identity, ownership, authorization or legitimation before a third-party custodian, and always trying to apply minimization measures.

How we obtain data

We process data that:

  1. you provide us directly when completing forms, contracting the service or communicating with us;
  2. are generated during the provision of the service;
  3. we receive from third parties involved in the file, such as airports, airlines, hotels, transport companies, lost property offices, logistics operators, payment gateways or technological providers;
  4. come from the person acting on behalf of another, in which case the person providing them guarantees that they have sufficient legitimation to do so and, where appropriate, that they have previously informed the affected party.

Purposes and legal bases of processing

BelongBack processes your data for the following purposes and on the following legal bases:

a) Manage your request, prepare a quote or answer prior queries

Legal basis: application of pre-contractual measures at the request of the data subject.

b) Formalize the contract and provide the requested service

Legal basis: performance of a contract.

c) Process the file for the location and recovery of the lost item

Includes analyzing the case, identifying appropriate channels, contacting third parties, sending necessary information, following up and communicating progress or incidents to you.

Legal basis: performance of a contract and, where appropriate, application of pre-contractual measures or actions in the interest of the client.

d) Manage payments, billing, accounting and regulatory compliance

Legal basis: compliance with legal obligations.

e) Prevent fraud, abusive use of the service, impersonations or unfounded claims, as well as protect the security of the website and our systems

Legal basis: BelongBack's legitimate interest in preserving the security and integrity of the service and defending against abuse.

f) Handle incidents, claims and exercise or defend legal rights or actions

Legal basis: compliance with legal obligations and legitimate interest in the establishment, exercise or defense of legal claims.

g) Send you commercial communications about similar own services, when there is a legal basis for it

Recipients of the data

Your data may be communicated, to the extent necessary for each purpose, to:

  2. courier, transport, logistics, packaging, customs or insurance companies, when the collection, shipment or return of the item so requires;
  3. financial institutions, payment gateways, accounting, tax or legal advisors;
  4. technological providers that provide us with hosting, email, storage, customer service, communications, analytics, security, automation or other tools necessary for the operation of the service;
  5. judges, courts, law enforcement agencies, public administrations or competent authorities, when there is a legal obligation or it is necessary for the defense of legitimate rights and interests.

BelongBack does not sell personal data to third parties.

International data transfers

Given the global nature of the service, some processing or communications may involve international data transfers outside the European Economic Area (EEA).

These transfers can occur in two different scenarios:

a) Transfers derived from technological providers or stable collaborators

If we use providers located outside the EEA or with remote access from third countries, the transfer will be covered, where appropriate, by an adequacy decision of the European Commission or by legally valid appropriate safeguards, such as standard contractual clauses or other mechanisms recognized by applicable regulations, together with any necessary supplementary measures.

b) Necessary transfers to process your file at your request

In these cases, the transfer will be limited to adequate, relevant, and non-excessive data for the specific case. BelongBack will try to avoid unnecessary submissions and will apply minimization criteria.

Some destination countries may not have an adequacy decision from the European Commission or offer an equivalent level of protection to that of the EEA. In such cases, BelongBack will act proportionately and limit the transfer to what is strictly necessary for the intended purpose.

Data retention

We will retain your data for the time necessary for the purpose for which they were collected and, subsequently, for as long as legal, contractual, accounting, tax or administrative liabilities may arise.

In general terms:

  1. file data will be kept while the case remains open and for the time necessary to manage incidents, claims or possible associated liabilities;
  2. contracting, payment and billing data will be kept during the applicable legal terms;
  3. data used for commercial communications will be kept as long as you do not withdraw your consent or object to the processing, as appropriate;
  4. logs and technical data will be kept for the time reasonably necessary for security, auditing, fraud prevention and service continuity.

Where appropriate, the data will be blocked and will only be kept at the disposal of competent authorities, courts and tribunals during the legally required periods.

Mandatory or voluntary nature of the data
